Terms of service
The agreement between you and Elementarium. It is written to be read — particularly the section on where engineering responsibility sits, which is the one that matters most in this trade.
Last updated 14 October 2026
Who you contract with
These terms are an agreement between you and Elementarium ("we", "us") — the trading name of Jan Vorisek, registered entrepreneur (OSVČ) in the Czech Republic, IČO: 08090441, registered seat Hudečkova 1094/7, 140 00 Prague, Czech Republic. Full registration details are on the imprint page.
By creating an account or using the service you accept these terms. If you are agreeing on behalf of an employer or client, you confirm you are authorised to bind them, and "you" means that organisation.
What Elementarium is
Elementarium is a finite element workspace for structural engineering that runs in a web browser: modeling, meshing, load cases and combinations, linear static, modal and buckling analysis, design checks, reporting, cloud sync and collaboration. The solver executes on your own hardware; your account and projects are stored and backed up on our infrastructure in the EU.
Beta status
The service is in public beta. It is good enough for real work — it is used for real work — but you should read that word literally:
- Features may change, move or be withdrawn, including ones you rely on.
- There is no service level agreement and no uptime guarantee at this stage.
- Defects are possible in any part of the product, including the solver and the design checks.
- Keep your own copies of work that matters, exported from the app.
The rest of these terms, and particularly engineering responsibility, should be read in that light.
Accounts
- Give accurate registration details and keep them current.
- An account belongs to one person. Credentials are not to be shared; add collaborators instead.
- You are responsible for what happens under your account. Tell us promptly at [email protected] if you think it has been compromised.
Plans and limits
There is a free plan and a paid plan. The free plan is capped — currently three cloud projects, models up to 500 degrees of freedom, one design check per project, watermarked reports and no collaborators — and the paid plan removes those caps and adds real-time collaboration. Every analysis type and every design module is on both. The authoritative, current list is on the pricing page.
We may adjust free-plan caps as the product develops. If a change would affect projects you already have, you will be told in advance and given time to export or upgrade.
Billing and renewal
- Payments are processed by Stripe. We do not receive or store your card number.
- Subscriptions renew automatically — monthly or annually, whichever you chose — until cancelled. The charge is taken at the start of each period.
- The prices on the pricing page are final. Nothing is added at checkout, and that will not change if Elementarium becomes VAT registered.
- If a payment fails we will retry and email you. Access to paid features may be suspended if it keeps failing, but your projects are not deleted for non-payment.
- We may change prices. Existing subscribers get at least 30 days' notice by email, and the new price applies from the following renewal — never mid-period. If you don't like it, cancel before it takes effect.
Cancelling
Cancel at any time from your account settings. Cancellation takes effect at the end of the period you have already paid for; until then nothing changes. Afterwards the account reverts to the free plan.
Your projects stay in your account when you cancel. Those over the free-plan caps become read-only rather than being deleted — you can always open, export and print them, and resubscribing restores full access.
Consumer withdrawal
If you are a consumer in the EU, you have 14 days from concluding the subscription to withdraw from it, without giving a reason. Write to [email protected] within that period.
Because the service is made available immediately, by subscribing you ask us to begin performance during the withdrawal period. If you then withdraw, you owe a proportionate amount for the part already provided, and the right to withdraw ends once the service has been fully performed for the period in question. Statutory rights of consumers under Czech law are not affected by anything in these terms.
Engineering responsibility
This is the section to read twice.
Elementarium is a calculation tool for qualified professionals. It does not perform engineering judgement, and it does not take professional responsibility for a structure. You do.
In using the service you accept that:
- Idealisation is yours. Element choice, boundary conditions, mesh density, load paths and combinations are decisions the software cannot make for you, and a model that solves cleanly can still be the wrong model.
- Results must be verified. Check output against hand calculations, established results or an independent package before relying on it. Our own testing is not a substitute for that check, and nothing in these terms shifts it to us.
- Design checks are an aid, not an opinion. They implement published code provisions as we understand them. Whether a clause applies to your structure, in your jurisdiction, under the relevant national annex, is an engineering judgement that remains with you.
- Output is not a substitute for a competent design. Nothing produced by the service may be issued for construction, tender or approval without review and adoption by a suitably qualified engineer who takes responsibility for it.
- Report defects. If a result disagrees with a hand calculation, tell us. We would rather fix a solver bug than learn about it from a structure.
Your models
You keep all rights in the models, geometry, data and documents you put into the service. We claim no ownership of them.
You grant us only the narrow licence needed to run the product: to store, encrypt, transmit, back up, render and — where you have shared a project — display your data to the people you shared it with. Nothing else. We do not use your models to train anything, and we do not disclose them, as set out in the privacy policy.
You are responsible for having the right to upload what you upload, and for exporting anything you need to keep before closing your account.
Our software
The service, the solver, the interface and the documentation remain ours. Subject to these terms you get a non-exclusive, non-transferable right to use the service for its intended purpose during your subscription. You may not resell it, redistribute it, reverse-engineer it beyond what mandatory law permits, remove notices from generated reports, or use it to build a competing product.
Acceptable use
- Don't break the law with it, or infringe anyone's rights.
- Don't attack the infrastructure, probe it without written permission, or attempt to reach accounts and data that are not yours.
- Don't circumvent plan limits, share one account among several engineers, or automate access in a way that degrades the service for others.
- Don't upload malware or content you have no right to hold.
Security researchers are welcome — write to [email protected] before testing and we will agree a scope.
Availability and changes
We aim to keep the service available and to warn you about planned maintenance, but during beta we do not guarantee uninterrupted operation. Because the solver runs locally and the app works offline, an outage on our side generally affects sync and sign-in rather than your ability to work.
We may add, change or remove features. Where a change materially reduces functionality you are paying for, you will be told in advance and may cancel with a refund of the unused part of the period.
Warranties
The service is provided as it is. Beyond what mandatory law requires — including consumer rights, which are unaffected — we make no warranty that it will be uninterrupted, error-free, or fit for a particular project, and no warranty that results are free of defects. The engineering responsibility section describes how to handle that in practice.
Liability
Nothing here limits liability that cannot be limited by law: damage caused intentionally or by gross negligence, harm to life, health or a person's natural rights, and consumers' statutory rights.
Otherwise, and to the extent the law allows: we are not liable for indirect or consequential loss, loss of profit, loss of contracts, cost of remedial construction works, or loss of data where you could reasonably have kept an export. Our total liability arising from the service in any 12-month period is limited to the amount you paid us in that period.
This allocation reflects the price of the product and the fact that the professional responsibility for a design sits with the engineer who signs it.
Suspension and termination
You may close your account at any time. We may suspend or terminate an account that materially breaches these terms — most often the acceptable use section — and will normally warn you first and give you a chance to fix it, except where the breach is serious or unlawful.
If we terminate without cause, we refund the unused part of your period. On termination you have 30 days to export your projects before deletion, unless the law requires us to keep something for longer.
Governing law and disputes
These terms are governed by the law of the Czech Republic, and the Czech courts have jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory rules in your country of residence.
Consumers may also take a dispute to the Czech Trade Inspection Authority (Česká obchodní inspekce, coi.cz) for out-of-court resolution, or use the EU online dispute resolution platform. Talking to us first is usually faster than both.
Changes to these terms
We may update these terms as the product develops. Material changes are announced by email to account holders at least 30 days before they take effect; continuing to use the service after that means you accept them, and if you do not, you can cancel. The date at the top shows the current version.
Something here unclear, or wrong? Tell us — we read every message, and a document that confuses its reader is a defect like any other.
